			<content:encoded><![CDATA[ Ende 2011 ist eine in Köln ansässige Firma Kreuzer Contact-Center GmbH unter Verwendung und Herausstellung des für uns geschützten Namens <b>KREUZER</b> in Wettbewerb mit uns getreten. Da durch die Firmierung und das Verhalten dieses Unternehmens die Gefahr von Verwechslungen herbeigeführt wurde, haben wir uns dagegen sowie gegen weitere Handlungen gerichtlich zur Wehr gesetzt. 
 Kreuzer Contact-Center GmbH hat sich nunmehr auf dringendes Anraten des Landgerichts Köln im Rahmen eines Vergleichs dazu verpflichtet, umzufirmieren und den Namen <b>KREUZER</b> nicht mehr in Alleinstellung zu verwenden, weder in der Firmierung noch ansonsten im Wettbewerb. Gegen die Umfirmierung hat sich dieses Unternehmen bis zuletzt gewehrt, die nunmehr bestehende rechtliche Verpflichtung ist der Grund für die Umfirmierung in KCC GmbH. 
 Da dieses Unternehmen erst seit Mitte 2011 im Call-Center-Geschäft tätig ist, musste es sich auch dazu verpflichten, sich nach einer Umstellungsfrist bis 31.05.2013 nicht mehr einer 24-jährigen Erfahrung zu rühmen, auch nicht einer angeblich 24-jährigen Berufserfahrung des Inhabers, der früher in unserer Gesellschaft tätig war, als Prokurist allerdings nur wenige Wochen. Daneben sind auch weitere von uns angegriffene Verhaltensweisen zukünftig zu unterlassen. 
 Der Name <b>KREUZER</b> ist ein Begriff in der Call-Center-Branche und steht für seriöse, zuverlässige und kreative Arbeit unseres erfahrenen Teams. 
 Wir sind die einzige und eigentliche Firma <b>KREUZER</b>, gegründet von dem bekannten Unternehmer Erwin Kreuzer. Dieses ist nach der gerichtlichen Auseinandersetzung nunmehr wieder klargestellt, wobei wir bedauern, dass für die Einsicht in die Unzulässigkeit der Firmierung und anderer Handlungen eine gerichtliche Auseinandersetzung erforderlich war. 
 Wir setzen uns weiterhin für Seriosität und Sauberkeit in unserer Branche sowie einen fairen Wettbewerb ein und werden uns auch zukünftig gegen die Verletzung unserer Rechte und der Grundsätze eines fairen und lauteren Wettbewerbs zur Wehr setzen.

This  jurisdiction contradicts all previous estimations of the Federal Supreme  Court, who particularly classified the double-opt-in-process as valid  form of obtaining an agreement (see: Federal Supreme Court from Feb.  10th 2011, File number I ZR 164/09 - Double-Opt-In).<br /> <br /> Therefore, a new clarification from the Federal Supreme Court is necessary.<br /> <br /> A variety of companies from all Germany is regularly sending information  to customers and registered newsletter- and marketing-prospects.  Creating legal hurdles, as by the Higher Regional Court Munich, in our  opinion is lacking in practical relevance and harms the legitimate use  of email-marketing. 			<content:encoded><![CDATA[The company “KREUZER Dialogmarketing GmbH” is actively taking a step towards environmental protection by now obtaining all the electricity which is required for the operation of its information and communication technologies from the power supplier “naturstrom AG” which provides 100% eco-friendly green electricity. This environmentally responsible approach is equivalent to a climate protection effect of more than 250 trees in the year 2011 alone. The renewable energy sources which are being used include biomass, water, wind and solar energy.
<br /><b>KREUZER has gone green before</b><br /><br />Changing the power supplier is not the first action KREUZER has taken to protect the environment.
